Private Investigator Evidence in Court: What Holds, What Gets Thrown Out, and Why
People think the work ends when there is a photo. It does not. A photo obtained the wrong way is worth less than the paper it is printed on. The difference between evidence and a legal problem is how it was collected.
Start with what works. Visual documentation collected in public space, a street, a cafe, a parking lot, a hotel lobby, is admissible and used routinely in family courts and civil proceedings. An organized investigator's report with a timeline and locations carries evidentiary weight, and the investigator can testify to the findings.
Now for what gets disqualified, and this is where most of the damage is done. Wiretapping another person's calls is a criminal offense under Israel's Secret Monitoring Law, and its product is inadmissible. Hacking a partner's phone, email or accounts, same story, plus an offense under the Computers Law. Documentation inside private premises, hidden cameras in bedrooms, tracking devices attached unlawfully: these may not only be disqualified, they can turn the person holding them from plaintiff into defendant.
This is why Israeli law requires a private investigator's license from the Ministry of Justice. A licensed investigator knows where the line runs and builds the case so every finding survives cross-examination. An unlicensed one, or worse, a friend doing a favor, can burn your entire case.
